1. Acceptance of Terms

By accessing or using Valenke ("the Service"), operated by Valenke ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

Valenke is an adaptive exam-preparation platform that delivers practice questions, performance analytics, and study recommendations for professional certification exams. The Service uses psychometric methods including Item Response Theory (IRT) and Expected A Posteriori (EAP) estimation to personalize question difficulty to each user's ability level.

3. Educational Purpose Only

Valenke is a supplemental study tool designed to help you practice and assess your readiness for certification exams and professional interviews. The Service does not guarantee that you will pass any exam, obtain any certification, or receive any job offer. Exam content, passing standards, and hiring criteria are determined solely by the respective certifying organizations and employers, and may change at any time without notice to us.

4. No Affiliation with Certifying Bodies or Employers

Valenke is an independent company. We are not affiliated with, endorsed by, or sponsored by any certifying organization, testing body, or employer referenced on this platform. All certification names, exam names, and employer names are trademarks of their respective owners and are used here solely for descriptive and informational purposes. 5. No Professional Advice

Nothing on Valenke constitutes medical, legal, financial, or other professional advice. Content related to healthcare certifications (e.g., EMT, Pharmacy Technician, Surgical Technologist, Medical Assistant) is for exam-preparation purposes only and must not be used to make clinical decisions. Always defer to licensed professionals and official guidelines for professional practice.

6. User Accounts

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate, current information when registering and keep it up to date.

You must be at least 18 years old to create an account. By registering, you represent and warrant that you are 18 or older.

7. Subscriptions and Payment

Valenke offers both free and paid subscription tiers. Paid subscriptions are billed through our payment processor, Dodo Payments. By subscribing, you authorize recurring charges at the applicable rate until you cancel.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access until then.

8. Refund Policy

Monthly plan ($11.99/month): Monthly subscriptions are non-refundable. You may cancel at any time, and your access will continue through the end of the current billing cycle.

Annual plan ($95.88/year): Annual subscriptions are eligible for a full refund if you request one within the first 7 days of purchase and have answered fewer than 20 practice questions. Once either threshold is exceeded, the annual subscription becomes non-refundable. To request a refund, email support@valenke.com with your account email and the reason for your request.

9. Intellectual Property

All content on the Service -- including practice questions, explanations, algorithms, readiness reports, adaptive models, and study recommendations -- is the property of Valenke or its licensors and is protected by copyright and intellectual property laws. All practice questions are original works created by Valenke; none are copied from actual certification exams or proprietary question banks.

You may not reproduce, distribute, publicly display, or create derivative works from any content on the Service without prior written permission from Valenke.

10. Prohibited Conduct

You agree not to:

  • Share your account credentials with others or allow others to use your account
  • Attempt to reverse-engineer, decompile, or extract the question bank, adaptive algorithms, or IRT parameters
  • Use automated tools (bots, scrapers, browser extensions) to access or extract content from the Service
  • Redistribute, publish, screenshot, or commercially exploit any questions, explanations, or reports from the Service
  • Interfere with or disrupt the Service, its servers, or its infrastructure
  • Misrepresent your identity, affiliation, or the source of any content
  • Use the Service for any unlawful purpose

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Valenke does not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content is accurate, complete, or current.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Valenke AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF INCOME, DATA, CERTIFICATION OPPORTUNITIES, OR EMPLOYMENT PROSPECTS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Valenke's total aggregate liability for any claim arising from the Service shall not exceed the amount you have paid to Valenke in the twelve (12) months immediately preceding the event giving rise to the claim.

13. Changes to Terms

We may revise these Terms at any time by posting the updated version on this page and updating the "Last updated" date. For material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. If you do not agree with the revised Terms, you must stop using the Service before the effective date.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
